anything which may reasonably be regarded as causing harm or undue offence<\/em><\/p>\n\n\n\n<p><em>(b)&nbsp; anything which may reasonably be regarded as likely to promote, or incite crime,<\/em><\/p>\n\n\n\n<p><em>(c)&nbsp; anything which may reasonably be regarded as promoting or inciting terrorism online within the terms of the EU Directive on combatting terrorism.<\/em> (* F\u00e9ach N\u00f3ta 1)<\/p>\n\n\n\n<p><em>(d)&nbsp; anything which may reasonably be regarded as likely to incite to violence or hatred directed against a group of persons,<\/em><\/p>\n\n\n\n<p><em>(e)&nbsp; anything which may reasonably be regarded as tending to undermine the authority of the State.<\/em><\/p>\n\n\n\n<p><strong><em>Privacy<\/em><\/strong><\/p>\n\n\n\n<p><strong>46K<\/strong><\/p>\n\n\n\n<p><strong><em>(1)<\/em><\/strong><em> A broadcaster shall ensure that, in programmes broadcast by the broadcaster, and in the means employed to make such programmes, the privacy of any individual is not unreasonably encroached upon.<\/em><\/p>\n\n\n\n<p><strong><em>(2) <\/em><\/strong><em>&nbsp;A provider of an audiovisual on-demand media service shall ensure that in programmes included in a catalogue of the service, and in the means employed to make such programmes, the privacy of any individual is not unreasonably encroached upon.<\/em><\/p>\n\n\n\n<p><strong><em>News and current affairs<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>46L (1)<\/em><\/strong><em> A broadcaster, in programmes which he or she broadcasts, and a relevant media service provider, in programmes which he or she makes available in a catalogue of the relevant service, shall ensure\u2014<\/em><\/p>\n\n\n\n<p><em>(a) that news is reported and presented in an objective and impartial manner and without any expression of the broadcaster\u2019s or provider\u2019s own views, and<\/em><\/p>\n\n\n\n<p><em>(b) that the treatment of current affairs, including matters which are either of public controversy or the subject of current public debate, is fair to all interests concerned, and that the matter broadcast or made available is presented in an objective and impartial manner and without any expression of the broadcaster\u2019s or provider\u2019s own views.<\/em><\/p>\n\n\n\n<p><strong><em>(2) <\/em><\/strong><em>Should it prove impracticable to apply subsection (1)(b) in relation to a single programme, 2 or more related programmes may be considered as a whole, if\u2014<\/em><\/p>\n\n\n\n<p><em>(a) where the programmes are broadcast, they are broadcast within a reasonable period of each other, or<\/em><\/p>\n\n\n\n<p><em>(b) where the programmes are made available on a relevant service, they are made available in the same way on the relevant service within a reasonable period of each other.<\/em><\/p>\n\n\n\n<p><strong><em>(3)<\/em><\/strong><em> Nothing in subsection (1) prevents a broadcaster from broadcasting, or a relevant media service provider from making available, party political programmes (*See Note 2), provided that an unfair preference is not given to any political party\u2014<\/em><\/p>\n\n\n\n<p><em>(a) by a broadcaster, in the allocation of time for such programmes, or<\/em><\/p>\n\n\n\n<p><em>(b) by a relevant media service provider, in the positioning of such programmes in a catalogue of the relevant service.<\/em><\/p>\n\n\n\n<p><strong><em>(4)<\/em><\/strong><em> Subsection (1), in so far as it requires a broadcaster or a relevant media service provider not to express his or her own views, does not apply to news or current affairs relating to a proposal which\u2014 (a) concerns policy as regards broadcasting which is of public controversy or the subject of current public debate, and (b) is being considered by the Government or the Minister.<\/em><\/p>\n\n\n\n<p><strong><em>Advertising<\/em><\/strong><\/p>\n\n\n\n<p><strong>46M <em>(1)<\/em><\/strong><em> A programme broadcast or made available in a catalogue of an audiovisual on-demand media service, may include advertisements inserted in it.<\/em><\/p>\n\n\n\n<p><strong><em>(2)<\/em><\/strong><em> A broadcaster shall not broadcast, and a relevant media service provider shall not make available in a catalogue of the relevant service, an advertisement which\u2014<\/em><\/p>\n\n\n\n<p><em>(a) is directed towards a political end or has any relation to an industrial dispute, or<\/em><\/p>\n\n\n\n<p><em>(b) addresses the issue of the merits or otherwise of adhering to any religious faith or belief, or of becoming a member of any religion or religious organisation.<\/em><\/p>\n\n\n\n<p>***Is f\u00e9idir le daoine den phobal ar mian leo gear\u00e1n a dh\u00e9anamh faoi fh\u00f3gra\u00ed a craoladh ar RT\u00c9 gear\u00e1n a dh\u00e9anamh freisin leis an \u00dadar\u00e1s Caighde\u00e1n F\u00f3gra\u00edochta d&#8217;\u00c9irinn (ASAI).<\/p>\n\n\n\n<p><strong>Access Services<\/strong><\/p>\n\n\n\n<p>Under&nbsp;<strong><u>Section 47<\/u><\/strong>&nbsp;of the Act, a &nbsp;complaint may also be made under the Access Rules of the regulator, pertaining to Subtitling, Irish Sign Language and Audio Description.<\/p>\n\n\n\n<p>The period to make a complaint is the same as outlined above for television. (The complaints process does not, as yet apply to a Video on Demand (VOD) service, such as the RT\u00c9 Player).<\/p>\n\n\n\n<p>However, while RT\u00c9 will endeavour to respond within&nbsp;20 working days&nbsp;this may not be possible in every instance, particularly if the complaint requires investigation into technical matters. In any such case, RT\u00c9 will advise the complainant of a likely timescale for a response to issue.<\/p>\n\n\n\n<p>It should also be noted that in respect of a complaint regarding Subtitling, we may request additional information, such as details of the device used and\/or provider used to access the broadcast. This is because it can happen that subtitling provided for an RT\u00c9 broadcast may not have the same standard on some devices and\/or platforms.
